How much improve the JUSTICE system with the new bills?
The amendment to yesterday's parliament bill introduced by the Ministry of Home Affairs by Mr. Amit Shah the 3 new laws replaced by IPC, CrPC, and IEA. The new one is Bhartiya Nyaya Sanhita, Bhartiya Nagarik Suraksha Sanhita, Bhartiya Sakshya adhiniyam.

1. Bhartiya nyaya sanhita - भारतीय न्याय संहिता
the previous IPC will replace by the Bhartiya nyaya sanhita bill 2023 which contains 356 sections as opposed to 511 sections. 175 sections have been amended, 8 new sections have been introduced and 5 sections abolished and add 22 parts/chapters.
feature in Bhartiya nyaya sanhita (BNS):add new offenses including sexual harassment, mob lynching, cyber terrorism
focus on human rights as aligned with international standards
separate provision for mob lynching, punishable with 7 years or life imprisonment or the death penalty.The punishments to which offenders are liable under the provisions of this Sanhita
are—
(a) Death;
(b) Imprisonment for life, that is to say, imprisonment for the remainder of a person’s
natural life;
(c) Imprisonment, which is of two descriptions, namely:—
(1) Rigorous, that is, with hard labour;
(2) Simple;
(d) Forfeiture of property;
(e) Fine;
(f) Community Service
previous IPC under punishment mainly 5 types, the new law amendment punishment 6 types one community service added.
like for smaller problems saying bad things about someone or behaving badly when drunk, people might have to do community service as a punishment.
if someone wants to complain about a crime they can do it from anywhere and within 15 days, it will be sent to the right police station.
The increase punishment for offence against women & children, create a new offence of "HATE SPEECH". The introduce a new bail regime that more restrictive than current regime.
The Bhartiya Nyaya Sanhita has provide more resources for police and judiciary to improve their capacity to investigate and prosecute crimes.
2. Bhartiya Nagarik Suraksha sanhita - भारतीय नागरिक सुरक्षा संहिता
Add 9 new sections. There are now 533 parts in 160 portions of the previous legislation have been altered.
more organized like divided into 13 chaptersefficiency on speedy trail, witness protection and video recording of interrogations
focus on transparency and accountability improvement on criminal justice system
3. Bhartiya Sakshya Adhiniyam - भारतीय सक्ष्य अधिनियमम्
instead of the previous 167 sections of IEA, now replace to Bhartiya sakshya adhiniyam will now contain 170 sections.
23 sections have been modified 1 new part has been inserted and 5 sections have been abolished permanently refined structure of 10 chapters for a better understanding
digital evidence addresses of admissibility of electronic evidence
credible testimony provision for witness testimony corroboration
gender neutrality on acts becomes more inclusive.
so here we raise the question of how much the bills change to make the justice system stronger? and, is it reliable for equality for all the citizens of India? the answer will only be depending on time. because right now the bill is being looked at by Loksabha then Rajyasabha later how many favors votes the president sign before it can become a real law implemented. let`s see what in upcoming days in future and what types of reforms in the justice system.
